A) Unlimited Data plans provided by Linknet are applicable only for the following cities aurangabad.

B)The Unlimited Data plans are only for personal use of the subscriber and cannot be used for any commercial purposes.

C)Any misuse/ fraudulent use/ unauthorised telemarketing and commercial use of the Broadband connectivity by the subscriber, Linknet reserves its right to discontinue the connection altogether for any set of Subscriber/s as Linknet may deem fit.

D)Linknet encourages responsible use of unlimited data by each of its subscribers. Linknet believes that even when a subscriber chooses to use the Unlimited plans extensively he or she may not be able to consume the maximum data limit of 3300 GB per month or above as per the tariff plan subscribed (hereinafter referred as "Maximum Data Limit"). Any such usage over and above said Maximum Data Limit will be treated as abuse of Unlimited Data plans by the said subscriber.

E)Linknet reserves its rights to withdraw the plan benefits in case the subscriber exceeds the said Maximum Data limit without giving any prior notice. The said withdrawal of plan benefits for such subscriber is done to ensure optimal use of Linknet’s network, to avoid abuse of Unlimited Data benefits by any such subscriber and in the interest of all its subscribers.

F)Upon Subscriber reaching the Maximum data limit (as per the plan subscribed), Fair Usage Policy shall apply and the plan speeds will be throttled as mentioned in the respective plans until the next billing cycle.

G)Unutilized data if any will be forfeited at the end of every month and the same cannot be carried forward.

H)These Terms and Conditions shall be read along with the terms and conditions of the Customer application Form duly signed by the Subscriber.

I)These Terms and Conditions shall constitute an agreement between Linknet and each customer and by subscribing to the unlimited data plan, you accept the same as binding upon you.

J)Any dispute or claim arising out of or in relation to the above Unlimited Data plans shall be submitted to exclusive jurisdiction of Courts at Aurangabad alone.

k) The end user is responsible for compliance of Information Technology Act…., Linknet…is not responsible for any act of violation of information technology act & Information technology offences using internet connection provided by Linknet.

l) All disputes are subject to Aurangabad(MH) jurisdiction.

Intellectual Property Clause - Linknet shall have the right to undertake inspections at the specified address or premises of the Customer to check for the bona-fide usage of the Services and to ensure that there is no violation of its/any third parties’ Intellectual Property Rights (IPR). The Customer shall provide cooperation, facilities and access to Linknet for the same. In case on such inspection it is found that the Customer is indulging in any act or omission which amounts to violation of the terms and conditions contained herein or IPR, Linknet or its employee or agent shall be entitled to take photograph or video graph of such violation or any other measure necessary for recording such violation. Nothing contained herein shall be deemed to grant the Customer either directly or by implication, any right, by license or otherwise, in respect of any Intellectual Property, inter-alia, in any software, concepts, know-how, processes, development tools, techniques or any other proprietary material or information that Linknet may provide to the Customer in the course of provision of Service.

Disclaimers and Liability Limitation - Linknet makes no express or implied warranties, guarantees, representations or undertakings whatsoever regarding the Service/equipment/ Digital Services etc. unless expressly mentioned in the Form. Linknet shall not be liable to Customer and/or any person, firm, body corporate claiming through, under or in trust for the Customer and the Customer hereby waives and agrees to continue to waive all claims/actions of any delays, losses including, but not limited to, loss to business, profit, revenue or goodwill demands fees, cost, expenses, order judgment, etc. direct, incidental or consequential arising out of any delays, errors or defects or other failure with respect to the Service/ Digital Services and all additional/supplemental Service, equipment or billing, payment or collection to the extent such interruption. Further the Customer remains solely responsible for his own negligence, acts or omission.

Refund and cancellation

1) No refund or cancellation would be allowed once the payment is done.

2) In case customer opts for termination of services, s/he has to submit a formal written termination request to Linknet Broadband Private Limited. Modem Deposit, if any, would be refunded after adjusting outstanding, if any, from the customer, after modern is returned. Refund will be made only by cheque/NEFT, irrespective of mode of collection, in favour of the subscriber's name as per the Company's records. Subscription fee & one-time payments, including installation charges and Modem Rental if any, will not be refunded in any case. No interest will be payable by company on any amount of refund.
